What Is Medical Negligence

Clinical negligence or medical negligence are terms used to describe the situation where you, or a loved one, have suffered a significant injury (physical and/or psychiatric) in a medical setting by the negligent act or failure to act, of a healthcare provider.

To be considered clinical or medical negligence there must be input from a healthcare provider (doctor, surgeon, nurse, physio, optician, occupational therapist etc). That input can be a clinical management decision, health advice, surgical or medical intervention etc.

A medical setting includes within a hospital, at a GP practice, whilst under the care of a nurse or physiotherapist etc.

The healthcare provider may have actively caused your injury. For example, where a doctor (negligently) prescribed you too much of the wrong medication, which resulted in you being very ill, or where they misread some imaging and told you there was nothing wrong.

Alternatively, there may have been a failure by the healthcare provider. For example, where a nurse failed to give you your medication at the prescribed time, and that failure led to you being very ill, or where a surgeon failed to remove an instrument during surgery.

You can be compensated for reasonably foreseeable injuries that you can prove were caused by negligence.
