Tribunal Fee Changes Time To Update HR Policies

Date Added 28.07.17

As you have no doubt been hearing, the fees for lodging tribunal claims have been declared unlawful by the Supreme Court. Since 2013, when the fees were introduced, there was about an 80% reduction in employment tribunal claims being brought. Currently tribunals are not accepting fees for new applications where they are lodged in a hard copy format and those who have paid fees since 2013, are going to be reimbursed. The regime will almost certainly be replaced, but for now it’s free to bring a claim.

Therefore, given the significant reduction in tribunal claims over the past 4 years, employers may have felt less threatened by employment claims being brought against them. The risk profile for bringing claims has currently changed. We may see a surge in tribunal claims being brought now that that the financial barrier to doing so has been lifted.

When was the last time you reviewed your policies and procedures?

With the fees currently not needing to be paid, it’s time to make sure your “house is in order” Are your employment policies and procedures up to date and legally compliant? Carrying out fair processes with employees can reduce the risk of claims being brought and where a claim is still brought, it can increase the prospects of successfully defending it.

How can Tollers help?

We can review your policies and procedures. At Tollers we offer a Tollers HR package, which provides employers with peace of mind HR advice for a fixed 12-month period. It also provides companies with direct access to employment solicitor for advice. Furthermore, we take out insurance through an independent insurer, so you can be assured that should you have a tribunal claim, having followed our advice, the insurance is there to cover you. As part of the package we become custodians of your handbook and contracts and can review them to make sure that they are up to date.

What do our clients say?

“Since starting as Finance Director at Chiltern Cold Storage two years ago, we have used the Tollers HR package for both the provision of HR advice, as well as underwriting any Industrial Tribunal costs should this ever be necessary.

Whilst we have not needed the Industrial Tribunal insurance policy, we have regularly used the provision of HR advice on areas as diverse as redundancies, restructuring, contracts, employment disputes and disciplinary issues.  The advice given has always been provided in a prompt, friendly yet professional manner and has made a major difference to the way in which we have been able to manage our business and run our operations.

We would have no hesitation in recommending Tollers service to others, especially where a business is too small to justify its own HR department “ – Paul Jephcott – Chiltern Cold Storage

“We have worked with Rebecca and her team since June 2015.  She has been invaluable in assisting us to put in place a wide variety of procedures concerning our employees, everything from discussing the best HR process to put in place and how best to follow this process, reviewing letters, dealing with employee disputes right through to advising on dismissal.  Rebecca has an excellent understanding of our industry and her help and support have assisted us in various commercial decisions we have had to make.” – Gary and Paul McManus – McManus Managed Pubs
