Tribunal Fee Changes Time To Update HR Policies
As you have no doubt been hearing, the fees for lodging tribunal claims have been declared unlawful by the Supreme Court. Since 2013, when the fees were introduced, there was about an 80% reduction in employment tribunal claims being brought. Currently tribunals are not accepting fees for new applications where they are lodged in a hard copy format and those who have paid fees since 2013, are going to be reimbursed. The regime will almost certainly be replaced, but for now it’s free to bring a claim.
Therefore, given the significant reduction in tribunal claims over the past 4 years, employers may have felt less threatened by employment claims being brought against them. The risk profile for bringing claims has currently changed. We may see a surge in tribunal claims being brought now that that the financial barrier to doing so has been lifted.
