No Win No Fee Explained
Many people worry about consulting a solicitor and how much it will cost them to make a claim. If we think you have a good claim, we will run it under a Conditional Fee Agreement, better known as No Win, No Fee. For added protection and a risk-free claim, we also recommend that we obtain for you an “After the Event” (ATE) insurance policy. There is no up-front cost to you.
What Happens When You Win?
When you win your claim, you will receive your compensation and your opponent pays the majority of your legal fees and disbursements (eg. the cost of medical reports and court fees) we have incurred on your behalf.
When you win, some of the fees are not paid by your opponent. Those fees will be deducted from your compensation. The maximum payable by you is 25% of the compensation you receive.
What Happens If You Lose?
We only take on claims that we think have good prospects of success. However, should you lose your claim you pay nothing, provided you have complied with your obligation to us and the ATE insurer.
- We will not ask you to pay any costs.
- The ATE policy will pay your disbursements and your opponent’s costs.
- The ATE premium is written off.
When Does No Win, No Fee Not Apply?
The No Win, No Fee rules are different for certain types of claim such as an asbestos related condition, e.g. mesothelioma. We can explain these to you in more detail over the phone.
