The Defendant must therefore show that the body of opinion relied upon in their defence is logical and takes into account the comparative risks and benefits. If the Courts feels that other experts in that specialist would have done the same, it will help to show that your doctor acted reasonably.

If however the alternative body of opinion feels that a different course of action could or should have been taken, then you should be successful in your claim.
