Birth Injury Negligence Claims
We understand that the birth of your child is one of the most important events of your life. If anything goes wrong, you should have sensitive and experienced solicitors on your side. Tollers Solicitors are experts in birth injury claims. Tollers specialist lawyers have helped many clients with successful medical negligence claims. We also play an important role in helping you and your child through the rehabilitation process and provide care, support therapies and education.
We will see you at home, in hospital or at one of our offices, completely free of charge.
Some injuries or conditions are unfortunate natural events. No less devastating but not involving negligence by the doctors or nurses. Everyone is entitled to quality antenatal care. Unfortunately, the level of care given by doctors, nurses and midwives can fall below an acceptable standard and this can cause avoidable injury to the baby and sometimes the mother.
We will advise you with honesty and clarity whether we believe you have a valid claim. If we do, we can act on a risk free ‘No Win No Fee’ basis.
How Tollers can help with a childbirth negligence claim
These types of cases can be complex, both legally and medically. As well as considering any physical injuries you or your child may have suffered during birth, we also recognise that the experience will affect you as a parent psychologically. With this in mind, we will ensure that, in addition to securing financial compensation, you receive the right treatment and support through a stressful and emotional time.
Types of childbirth injury
Our experience covers all types of injury to both child and mother but some of the more common injuries are:
Injuries to babies:
- Cerebral Palsy/Erbs Palsy
- Brain injuries
- Cuts and scars
- Hip dysplasia
Cerebral Palsy is one of the most common birth conditions and in the UK it affects 1 in every 10,000 babies. There are many variations of the condition and unfortunately a cure has yet to be found.
It can be caused when the baby’s brain is starved of oxygen during birth. 1 in 5 of those born with Cerebral Palsy are avoidable and are caused through failures of medical staff during birth, often simply by failing to spot difficulties and acting quickly.
This is where the baby’s shoulders can get “stuck” because the shoulders are too big for the mother’s pelvis, once the head is delivered. It should be spotted during labour and steps taken to prevent injury during delivery. The nerves in the shoulder can be paralysed, causing a permanent limp or paralysed arm.
Brain injuries during birth usually cause lifelong difficulties. Children are very resilient but they and their families will need help and assistance for many years and often for the rest of their life. Whilst the NHS can provide some care, life can be very tough and demanding for everyone and additional funding for treatment, rehabilitation and care can be provided as part of a claim.
Sometimes brain injury or other nerve injury can occur if forceps are used in delivery and this can also cause injury to the mother, sometimes with very serious consequences.
Injuries to mothers:
- Anaesthetic errors
- Caesarean sections
- Episiotomies that have gone wrong
- Injuries to organs
- Perineal infections
- Placental abruptions
- Retained swabs
