Legal tips and advice now you have bought your property

Congratulations on buying your new home, we hope you are settling in.

We all know that buying a new house is likely be the biggest purchase you will make in your lifetime, and whether this is your first house, or you are a seasoned buyer, we know you will want to consider ways to ensure that you and your family are protected.

At Tollers we understand that there are endless things that you will be organising in regard to your new home, however, we always encourage you to consider other important life areas now you have moved in.

Depending on your situation, there will be a variety of personal matters you may wish to address.

For example, if you are a first-time buyer, you may like to make a Will to ensure that your wishes in regard to your new home are recorded, should the worst happen.  A Will specifies who should benefit from a person’s assets after they have died.  At Tollers we always advise updating your Will every time something major happens in your life, e.g., buying a property, having a child, making an investment or inheriting a sizeable amount of money – so that if you die, your family understands your wishes and how you would like your estate to be distributed.

On the other hand, if you are a more seasoned property owner, you may want to utilise your property for different reasons.  For example, if you have grown-up children who are looking to buy a property of their own, you might want to consider re-mortgaging your home to help them get on to the property ladder.  Re-mortgaging is the process of paying off an existing mortgage and replacing it with another (for the same or an increased sum) – typically secured against the same property.

Once you have settled in and the boxes have all been unpacked you may be planning some home improvements and looking to releasing equity from your property to help pay for the changes you would like to make.  Equity release is a means of releasing money from your property, helping you to remain in your home either for the rest of your life or until you decide to sell, as the legal owner.
