Misdiagnosis Compensation Claims

Misdiagnosis can mean an incorrect diagnosis or a failure to diagnose. Failure to diagnose includes missing the diagnosis altogether or delaying diagnosis in a way that may cause the patient harm.

If you have suffered as a result of negligent misdiagnosis, there are many ways Tollers expert injury lawyers can help you. We start by establishing what went wrong, and how, so we can determine whether the misdiagnosis was negligent. If so, we also need to establish the nature and extent of the damage it has caused.
If there was a delay in diagnosis but no damage was caused you will not be able to claim for compensation. An example may be where someone attends a hospital and is told that they have suffered severe bruising.  They are called the next day (once x-rays have been considered) to tell the patient that they have (in fact) suffered a fracture.  Providing the injury had not been made worse in that period, it is unlikely that a claim for compensation would be successful.

Common misdiagnoses

Misdiagnosis claims can include but are not limited to:

  • Medical reports or X-rays not being read or read incorrectly:
  • Test results not being carried out or acted upon
  • Symptoms not being correctly diagnosed
  • Failure to refer patients for medical treatment

Some medical conditions and diseases are harder to diagnose than others, including:

  • Asperger’s
  • Bowel cancer
  • Breast cancer
  • Colon cancer
  • Tendon injuries
  • Diabetes
  • Dyslexia
  • Dyspraxia
  • Ectopic pregnancy
  • Epilepsy
  • Skin cancer
  • Fractures

In some cases, the consequences of a misdiagnosis can be severe and, in extreme cases, fatal.
