Holiday Illness Compensation Claims
If you have suffered food poisoning or other illnesses caused by negligence, while on holiday or abroad, you should make a holiday illness claim for compensation for the illness and loss of enjoyment of your holiday.
Your tour operator must take all reasonable steps to ensure your health and safety while on holiday, so if they fail to do this, you may have grounds for a claim. However, it’s important to take into account that laws and regulations vary from country to country, and the legal side of these claims can be complex. With Tollers’ expertise on your side, though, you can expect a swift and efficient claims process, explained clearly, designed to achieve and the best possible result for you.
We have many years’ experience with holiday illness claims, for individuals and groups who have suffered illness while on holiday abroad through no fault of their own. If we think your claim has a reasonable chance of success, we can work on a ‘no win no fee’ basis.
Norovirus Claim
Norovirus, sometimes known as ‘winter vomiting bug’, is the most common stomach bug in the UK – there are at least 25 known strains of norovirus that affect humans. It is highly contagious, affects people of all ages, and there is no specific cure for it. Luckily, most of its symptoms only last a few days.
Norovirus is a particular problem for the cruise ship industry, where staff and passengers are confined to a relatively small area where norovirus spreads quickly. Once an outbreak occurs, passengers are confined to their cabins, and eliminating the virus is only possible by removing all passengers and crew, and undertaking a deep clean.
Symptoms of Norovirus include
- a raised temperature (over 38°C/100.4°F)
- headaches
- painful stomach cramps
- aching limbs
- vomiting
- diarrhoea
If you have suffered from norovirus on a cruise ship, you should make a holiday illness claim for the illness and also the loss of enjoyment of your holiday.
