Criminal Assault Compensation Claims

Tollers are experts in this field, and can provide clear, jargon-free advice on potential claims, along with a no-obligation assessment of whether you have reasonable chances of success. If you do, we can help on a ‘No Win No Fee’ basis.

How Tollers can help with an assault claim

We will listen to your full story in an empathetic way, making sure we understand what you want to achieve by claiming. We will then explain the legal process clearly, including what we must prove for your assault claim to be successful.

You may be able to make a civil claim against the assailant that caused your injury, or against your employer if the assault took place at work and they failed to take steps to prevent it.

Otherwise, you can make your assault claim to the Criminal Injuries Compensation Authority, in which case, your claim must meet certain criteria. For example:

  • The incident that caused your injury occurred less than two years ago. There are some exemptions if the victim is a child.
  • Your injury was serious enough to require medical treatment more than once.
  • You reported the assault to the police and helped them with any prosecution.
  • You don’t have a criminal record.
  • If your own behaviour before, during or after the assault in any way contributed to the assault or injury, any award may be reduced or disallowed altogether.
  • No compensation is paid for loss of earnings for the first 28 weeks.
  • The Criminal Injuries Compensation Authority pays no legal costs.
  • The maximum award is £500,000.

Throughout your assault claim, we’ll apply our expertise and experience to help you achieve the best possible result.
