Arrangements for Children
I advise clients on issues surrounding their children when they separate. Fortunately most parents are able to resolve any issues together and can reach an agreement about where children will live, what contact they will have with parents and arrangements over summer and Christmas holidays.
If agreements can be reached, no formal Court order needs to be set up and no written agreement needs to be drawn up. Having said that, some families prefer to have a written agreement in place so that if problems do arise it can be referred to.
If no agreement is reached or there are welfare issues, an application to the Court can be made. The Court will still encourage the parents to reach agreement - they have a no order principal. The Court will only make orders if absolutely necessary. Flexibility is encouraged between parents and if changes need to be made to orders in future an application to the Court would have to be made to vary the order.
If an order does have to be made and anyone breaches it then an application can be made to the Court to enforce the order. The Court will always consider the best interests of the children as all parents are encouraged to do. Don't hesitate to contact us for further information.
