Full Terms & Conditions

1. General

1.1 By using www.tollers.co.uk (the “Site”) you are agreeing to accept and be bound by the following terms and conditions, which together with our Privacy Policy govern our relationship with you in relation to you using this Site.

1.2 The term ‘Tollers LLP’ or ‘us’ or ‘we’ refers to the owner of the Site. Tollers LLP is registered in England and Wales with registered number OC329775 at Castilian Chamber, 2 Castilian Street, Northampton, NN1 1JX.

1.3 The term ‘you’ refers to the user or viewer of our Site.

1.4 The purchase of services from us is subject to our General Terms of Business, a copy of which is obtainable from us on request.

1.5 We may revise these terms of use from time to time by amending this page. Any changes made will be binding on you.  It is your responsibility to check this page and take notice of any changes we have made.

1.6 We aim to update our Site regularly and may change the content from time to time. Any of the material on our Site may be out of date at any given time and we shall be under no obligation to update such material.

2. Accessing our Site

2.1 Access to our Site is permitted on a temporary basis. We reserve the right to withdraw or amend the service we provide on our Site without notice.

2.2 We may restrict, from time to time, access to our Site. We will not be liable if for any reason our Site is unavailable at any time or for any period.

2.3 Furthermore we reserve the right to bar users or customers from access to either tollers.co.uk or any other website operated by us and any services contained within where a user or customer commits or seeks to commit fraud, attempts to disrupt in any way the services offered by us.

3. Use of the Website

3.1 Information held on this Site is intended for your general information and must not be used in any other way without our prior written consent.

3.2 Commentary and other materials posted on the Site are not intended to amount to advice on which reliance should be placed. We will not be liable for any reliance placed on such materials by you, any visitor to our Site or by anyone who may be informed of any of its contents.

4. Intellectual Property Rights

4.1 We are the owner or the licensee of all intellectual property rights in our Site which are protected by copyright laws and other intellectual property rights.

4.2 You may print off one copy and may download extracts of any pages from our Site for your personal reference and you may draw the attention of others within your organisation to material posted on our Site.

4.3 You must not modify the pages or digital copies of any materials you may have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

4.4 Our status and that of any identified contributors as the authors of material on our site must always be acknowledged.

4.5 You must not use any part of the materials on our Site for commercial purposes without obtaining a licence to do so from us or our licensors.

4.6 If you print off, copy or download any part of our Site in breach of these terms of use, your right to use our Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

5. Our Liability

5.1 Tollers tries to ensure that all documents and information contained within the Document Centre or any other part of tollers.co.uk or any other website operated by us are accurate and reflect the law at the time of use.

5.2 We shall not be liable for any losses that arise from relying upon the documents or information within either the Document Centre or any other part of www.tollers.co.uk or any other website operated by us or where you decide to act or not to act based upon the information contained within the Document Centre or any other part of the website.

5.3 The material displayed on our Site is provided without any guarantees, conditions, warranties or other terms, express or implied.

5.4 Neither the contents of the Document Centre or any other part of tollers.co.uk or any other website operated by us constitute individual legal advice. All of our services should be used in conjunction with proper legal advice where required.

5.5 To the extent permitted by law, we, hereby expressly exclude any liability for (i) any direct, indirect or consequential loss or damage, (ii) any loss of goodwill or reputation (iii) any economic losses (including loss of revenue, business, profits or contracts) incurred by any user in connection with our Site.

5.6 Our maximum liability to you in contract, tort (including, without limitation, negligence) or otherwise arising in connection with these terms or the website shall be limited to £50.

5.7 This clause 5 does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited under applicable law.  

Uploading Material to our Site

6.1 Whenever you make use of a feature that allows you to upload material to our Site, or to make contact with other users of our Site, you warrant that it does not contain any material which is defamatory of any person, is obscene, offensive, hateful or inflammatory, promotes sexually explicit material or violence or discrimination, infringes any copyright, database right or trade mark of any other person, be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety or any other material of this nature.

6.2 We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our site.

Viruses, Hacking and other Offences

7.1 You must not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of service attack.

7.2 By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.

7.3 We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any material posted on it, or on any website linked to it.

Online Payments

8.1 We currently only accept payment from the following debit/credit cards

             

8.2 All payments must be in Pounds Sterling (£). Any currency conversion costs or other charges incurred in making the payment or in processing a refund shall be borne by the you or the third party making payment.

8.3 We can usually accept payment by credit card but we reserve the right to make a 2% handling fee.

8.4 Payments received before 3pm on a working day will take 4 days to clear. Payments made out of office hours, at the weekends or at public holidays will be processed on the next working day.

8.5 It is your responsibility to ensure that you allow sufficient time for the payment to be processed online.

8.6 Once your payment has been authorised and verified by us, you will be provided with a unique transaction reference number. You can print this screen as your receipt for your payment. You should keep a note of the transaction receipt number as you will need to quote this if you have any queries with your payment.

8.7 We cannot accept any liability if payment is refused, the application screen will inform you of this. In this instance, you should contact your bank and/or make alternative arrangements to make payment.

8.8 Accepted payments will show on your account statements as payments to ‘Tollers LLP’.

8.9 We cannot accept liability for a payment not reaching the intended account due to you quoting an incorrect account, reference or invoice number.

8.10 If your payment is overdue, or time critical, and recovery action is about to be taken, your online payment will be accepted but you should additionally notify the service department by telephone, that the payment has been made quoting the reference that you have been given.

8.11 In the event that any payment made via our online payment system is to be refunded we will endeavour to make the refund to the card account or bank account from which the refundable payment was made, if for reasons beyond our control a refund cannot be made to the originating card/bank account, the refund will be made via cheque.

8.12 We shall not be liable for any failure by the user of this online payment system to properly protect data from being seen on their screen by other persons or otherwise obtained by such other persons, during the online payment process or in respect of any omission to provide accurate information in the course of the online payment process.

8.13 It is your responsibility to always check that the contact information you provide is correct before proceeding to payment.

Security

9.1 We provide a secure online payments facility, fully managed to Level 1 approval in line with the Payment Card Industry (PCI) requirements. Once you click on the link to make a payment you will be re-directed to a fully hosted secure managed environment. All information that you send will be fully 128 bit encrypted.

9.2 The online service is fully managed externally and we do not hold any card details on our servers or within our infrastructure. We, nor any of our officers, has any access to your card details on the managed service.

9.3 The online payments system complies with all of the security requirements of the PCI council – CV2 input, Verified by Visa, MasterCard SecureCode and we will continue to enhance the application to the highest security standards. 

10 Prices

10.1 The price of any products or services will be as quoted on our site from time to time or confirmed to you via email, except in cases of obvious error.

10.2 These prices exclude VAT.

10.3 Prices are liable to change at any time.

10.4 Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. We reserve the right to reject your order and notify you of such rejection if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.

11 Tollers Document Centre 

11.1 The Document Centre is an online service for purchasing individual legal documents and document packs.

11.2 Due to the electronic and personalised nature of the Document Centre no right of cancellation or refund exists under Regulation 13 of the Consumer Protection (Distance Selling) Regulations 2000 once a document or pack of documents has been purchased by you.

11.3 The purchase from the Document Centre gives you a licence to use the documents and legal information contained therein for the period of the licence, subject to limitations described in these terms and in our General Terms of Business sent to you on registration.

11.4 All the forms and resulting documents are and remain the copyright of Tollers Solicitors. Furthermore the copyright notice and document reference details at the end of each document shall not be removed or altered in anyway by the Customer.

11.5 You may not re-sell, re-publish, copy or distribute any document or any part thereof for use by any third party, including another organisation within a group.

11.6 You may not share your unique username or password used to access your account page.

11.7 You must notify us of any changes to your contact details, including your email address.

11.8 You must not use the email address supplied at the time of purchase to forward service announcements or notice of updates sent by us regarding the products and services to another email address, whether it is your email address or that of a third party.

11.9 We reserves the right to withdraw (without refund) access to any product where it is believed (solely by us) that usernames & passwords have been disclosed to a third party or documents have been shared.

11.10  If you suspect that your username & password are being used by a third party you should contacts us immediately via our Contact page.

11.11 Tollers will not issue any refunds either in full or part where access to any product is withdrawn due to a breach or suspected breach of these terms.

13 Jurisdiction 

13.1 This Site and any other operated by us are intended for the jurisdiction of England & Wales and as such should not be specifically used or relied upon for any other jurisdiction.  We do not accept responsibility for any such use.

13.2 These terms shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.
