Restrictive Covenants

As the economy is so often uncertain especially in light of the recent recession, the need for restricting the employment of employees after they have ceased employment with their employer is particularly important. Employers will need to consider that some employees may have knowledge of confidential information or trade secrets of their business or clients and that those employees may try to use this information for the benefit of their new employer or business.

Restrictions can be in place during and/ or after employment. The more senior the employee, the more prudent it is to ensure their contracts of employment contain restrictive covenants.
