The defect was sunken tarmac of a difference of 6cm which caused Mrs W to trip and fall and sustain a soft tissue injury to her cheekbone and right shoulder. Mrs W was successful in her claim against the PCT who failed to ensure that she was reasonably safe when using the premises as a lawful visitor under Section 2 of the Occupiers Liability Act 1957. Tollers LLP helped Mrs W to secure an award of compensation in the region of £3,000.00.
