Industrial Disease Claims
These are medical conditions that have been acquired due to work. So in fact they are a special type of Employers Liability claim. The same rules apply in determining whether you will be able to successfully claim compensation for the condition that has developed. You will need to be able to show that your employer has breached a duty of care that they owed you and that this breach of duty has caused the condition. These types of claims are more complex and more risky because;
- It may take some time for the condition to develop and so one might not be sure which employer was at fault;
- It may be difficult to determine what has actually caused the condition to develop – it could have just developed spontaneously.
