PERSONAL LEGAL INJURY CLAIMS

Improving your chances of success

There are a number of things that you can do to assist in improving the chances of your claim being successful:

  • Report your accident to the appropriate authorities - for example, car accident  - to the police; work accident - recorded in the Accident Report Book; holiday accident - to the Travel Representative.
  • Take full contact details of any witnesses who can prove what happened, who was at fault and why.
  • Take photographs wherever this might help. So, for example, the scene of the accident and anything that might prove blame, and also of the injury; any scarring. For a claim for tripping in a pothole, take a photograph of the pothole showing the measurement - please see examples (example 1; example 2; example 3) of what will be most helpful.
  • Visit your GP to record the accident and the injury, if you have not already been to hospital. Make sure you tell them clearly how you were injured (many claims are damaged by GPs recording an account of how the accident happened that differs from the one that we are told by you). Your GP and other medical records are likely to be viewed and referred to later by the medical expert who will, at the very least, find himself in difficulties if there are different versions of how the accident happened.
  • Respond promptly to requests from us.
  • Tell us of any change in your contact details.
  • Try to use email rather than the Royal Mail as usually it is more reliable and swifter. We would recommend that you put a "Read Receipt" on your mail which will confirm that we have received it safely. Obviously, original documents will still need to be sent through the post, but a scanned, e-mailed copy to us will ensure we all have a copy even if the Royal Mail manage to lose the originals.
  • Attend any medical examination we have organised. If there is any problem with you attending, PLEASE LET US KNOW IMMEDIATELY. Claims can be delayed considerably through failure to attend medical examinations and any other appointments.

If you have any concerns or questions at any time - PLEASE ASK YOUR CLAIMS HANDLER. We are here to help you and work for you and with you. We have helped, and are helping, thousands of people. One of the biggest delays that we face is a breakdown in communication where we cannot get a response from our clients.
