How do I pay your fees
The first thing is to be aware that it is in our interest, as well as yours, that you can afford to bring your claim. The simple answer to the question is that it is very unlikely that you will have to pay anything.
We will ensure that we do what is in your best interests at all times.
For most of our clients, the method used is a “no win no fee agreement” (the legal name for this is “Conditional Fee Agreement”). There is a bit of paperwork to fill in but we will help you. In summary, we retain the right to charge you for the work undertaken, which is a legal requirement, but in practice we choose not to do so in cases that are unsuccessful (so long as it has not failed because you have failed to work with us to win the case or there is fraud). If you win, your legal fees and expenses are paid by your opponent.
We will lend you (at no charge) the money to get medical reports, for Court fees and such like that need to be incurred to run your case. If you win, we will recover them from your opponent. If you lose, they will be covered by insurance (again, so long as you have not been involved in fraud and have co-operated with us to win your claim).
Your opponent’s legal costs – if you win, they will have to pay them themselves. If your claim is unsuccessful, then insurance should pay for this (again, so long as you have not been involved in fraud and have co-operated fully with us in trying to win your claim).
Other alternatives
Many people already have insurance. We will use the cover provided by that insurance, if it is in your interest and your insurers allow you to choose your own legal representation. (It is your right to make this choice free from interference, under the Human Rights Act. However, sadly several insurers seek to prevent consumers from exercising their freedom. If they do so do not worry – we can still help and protect you.)
Legal Help
This was formerly called ‘Legal Aid’. The government abolished this for injury claims many years ago, except in some very limited circumstances.
