No amount of compensation can compensate you for the loss of a loved one but even during this sad and difficult time practical decisions have to be made and consideration has to be given for the bereaved family or loved ones. When someone dies it will often result in those left behind suffering financial hardship, for example: due to the loss of their income. Compensation can be claimed on behalf of the Estate and also on behalf of the Dependents
A person's Estate recognises those legally entitled to benefit from the deceased's assets and is usually evidenced by a Will or Letters of Administration.
Claims on behalf of the Estate can include
Compensation for pain and suffering from the accident to the time of death Financial losses suffered before death
Funeral expenses
A headstone
Claims on behalf of Dependents are brought on behalf of persons the deceased would have provided for and include, for example, financial support (income) or regular services such as domestic or DIY services.
In addition, some Dependants may be entitled to claim bereavement compensation. This is a one off payment set by the Fatal Accident Act 1976 of £11,800.
One needs to look out for potential conflicts of interest where different people have a right to pursue the claim. It will help us if you can tell us early on of all the relatives of the person who has died and any wife/cohabite or other dependent.
