Employee Management on Return to Work
Where an employee is returning from a period of absence such as maternity or sick leave, certain processes must be followed.
In cases of maternity leave, consideration must be given in respect of the employee’s job and any changes carried out whilst she was away. Certain rules are in place depending on how long the employee has been absent. Any breach can result in claims for sexual discrimination.
In cases of sickness absence, consideration must be given as to the reason for the absence and reasonable adjustments in the work place to facilitate a safe return to work. In most cases it will be necessary to obtain medical opinion. Failure to appropriately manage sickness absence can give rise to claims for disability discrimination.
