Higher Education Disputes
Disputes can arise between students and Higher Education providers following allegations of plagiarism, cheating in examinations, exclusions, breach of contract, negligence and discrimination. We have the experience to advise on all these issues and more including internal procedures through to external appeals to the Office of the Independent Adjudicator for Higher Education (OIA) where it is believed there has been unfair treatment or an unfair hearing.

Office of Independent Adjudicator (OIA) Complaints
The OIA is an independent Body set up to review student complaints. If internal complaints procedures have been followed but a party to the final decision is unsatisfied with the final outcome, then an appeal may be prepared to the OIA. The OIA deals with individual complaints against Higher Education Institutions in England or Wales. We are able to offer advice in the merits of such a complaint and to assist in the preparation of such an appeal.

Internal Complaints Procedures
Often Education Bodies have complex and unclear appeals processes. We are able to advise and prepare an appeal against the relevant education body. We can also advise Education Bodies on internal policies and potential adjustments where necessary to minimise scope for breaches or appeals against decisions made in accordance with a policy. We are also able to offer specialist advice as to the strengths or weaknesses of individual claims.

Judicial Review
Final decisions of an educational body may be contested further by way of Judicial Review. We have the relevant experience to advice on the merits of such a review and the necessary skills to prepare and/or defend a comprehensive application for review.
