INDUSTRIAL DISEASE CLAIMS ASBESTOSIS & MESOTHELIOMA

We all now recognise asbestos as a dangerous material. However, for a long time it was regarded as very useful and inadequate protective measures were taken for people working with it, even when the dangers had become known. The asbestos fibres can be breathed in and any one of them can spark off a reaction which can cause these diseases and ultimately death. The particular problem with these cases is the length of time that it takes for a condition to develop can mean that it is difficult gathering evidence to prove that something wrong was done or something that should have been done was not. Indeed it is not uncommon for the claims to fail because one cannot trace the company- which may have ceased to exist many years ago- or even if they can be traced, it is very difficult to find the insurer who insured the company at the time when the injury was caused.

It will help us raise the chance of success in your claim if you can clearly identify when you first became aware of the problems, when you first sought medical advice and when you first linked the problems to your work. If you have changed employer, please supply us with a complete list of all the people/companies you have worked for where you have used vibrating tools or anything has happened that might have contributed to the development of the condition. Also it will help us if you can trace witnesses as to the work conditions, if anyone else has suffered or complained about the conditions before hand.
