Dont forget the pension

It has recently been reported that only 15% of divorced women said that pensions were discussed as part of their divorce settlement (according to a survey by Scottish Widows in 2012). This is a surprisingly low percentage when a pension can be an extremely valuable asset, sometimes as and occasionally even more valuable than the matrimonial home.

COHABITEES BEWARE!!

The Supreme Court handed down its judgment for the case of Kernott v Jones in early November 2011. The brief facts of the case are that Mr Kernott and Miss Jones met in 1981 and in 1985 they jointly purchased a house as joint tenants with both parties contributing to the purchase price. The relationship deteriorated in 1993 and Mr Kernott moved out and bought a property elsewhere whilst Miss Jones continued to live in the former couple’s home paying all the expenses including the mortgage.
