No Win No Fee – what is it?
20/07/2011“No Win No Fee” is the colloquial name for a Contract which most commonly arises between Legal Advisors and members of the public. In this, the Legal Advisor offers to work for you but to waive their fee for the work done if the claim is unsuccessful. If the claim is successful, then they will charge a fee. In some circumstances, this is taken from the compensation that they have recovered for you. In other circumstances (presently, although the Government is seeking to change this), their fees and the other costs incurred in running the case (often called disbursements) can be recovered from your opponents on top of your compensation. As a ‘No Win No Fee’ Agreement transfers some or all of the risk from you to your legal advisor, often they will charge an additional fee (often called a ’Success Fee’) to reflect the risk they run of not being paid if the claim is not successful.
There are technical rules around this agreement which your Legal Advisor will explain to you.
These agreements are widely used in litigation relating to Personal Injury claims, some Clinical Negligence claims, in claims arising from breaches of Employment Contracts, in financial disputes.
