Child Maintenance and Gender
24/08/2010I have been contacted by an old client. He has been paying maintenance to his daughter pursuant to a child maintenance agreement which was turned into a court order.
His daughter has undergone a gender change. The question then became whether the client was required to continue to pay maintenance for a child who was a daughter when the agreement was reached about a son.
The answer was yes as the agreement was for a child and maintenance is payable whether or not the child was formerly of a different gender.
