Financial Issues

You and your spouse may be able to agree maintenance and how property and other assets should be divided.  If this is the case, the matter can be dealt with by consent and it will generally not be necessary for you to attend court.  If no agreement can be reached, there will have to be a full court hearing and it will be up to the judge to decide what will happen.

When making any decision relating to financial matters, it is the obligation of the judge to put the welfare of any children first.  We will advise you about court procedures, paperwork required and representation in court if you need to attend.

Both parties must provide full and frank disclosure of their financial position which would include, a valuation of any property and pensions and other savings plans.

The home - The court can make various orders regarding the family home which include:

  • A transfer from both names to just one name.  This may involve one partner paying a lump sum to the other.
  • A sale and division of the house proceeds.  This could happen after the partner living in the home remarries, cohabits or the children leave full time education.
  • An immediate sale if there is enough money for both partners to be adequately rehoused. We have a specialist conveyancing department to assist you with the sale or purchase of property.
